Rule 47
Arrangements for Opening Branch Offices
(1) If the licensee wants to open a branch office in the country where he has sent the workers, he should submit an application to the opening department with the following details for approval:-
(a) Country and place of opening of branch office,
(B) Detailed work plan of branch office operation and physical infrastructure and manpower details,
(c) Details of sending at least five hundred Nepali workers to work in the country where the branch office is to be opened,
(d) Attested copy of certificate of at least bachelor's degree and citizenship certificate of the principal person operating the branch office,
(e) Receipt of deposit of five lakh rupees to ensure that the work of the branch is carried out in accordance with the law.
(2) If the licensee wants to open a branch office within the country, he should submit an application to the opening department with the following details for approval:-
(a) Place of opening of branch office,
(B) detailed action plan of branch office operation and physical infrastructure and manpower details,
(c) Certified copy of the citizenship certificate of the principal person operating the branch office,
(d) Receipt of depositing two lakh rupees to ensure that the work of the branch is carried out in accordance with the law.
(2A) If the licensee does not comply with the conditions given to open the branch or if he commits any illegal act, the bond kept as per clause (e) of sub-rule (1) or (d) of sub-rule (2) will be confiscated and further action will be taken.
(2b) When applying for opening a branch office in accordance with sub-rule (1) or (2) after the commencement of this sub-rule, the details of the full-time employee or representative of the licensee acting as the head of the said branch and the recommendation that such employee or representative has not been found guilty by the court of any criminal charge involving moral turpitude shall be attached. (3) Upon the application received under sub-rules (1) and (2), the department may give permission to open a branch office if it deems it necessary to open a branch office as per the request of the applicant.
(4) Notwithstanding anything else written in this rule, the licensee who has opened a branch office at the time of commencement of this rule shall deposit the amount mentioned in clause (e) of sub-rule (1) or clause (d) of sub-rule (2) within three months from the commencement of this rule. .
